Bids are to be on a Bid form furnished with the contract documents and must be submitted in a sealed envelope with the name of the bidder endorsed on the outside, and state that it contains a bid on “Project B-2019, 1st Avenue Force Main Replacement”, and must be accompanied, in a separate envelope, by a bid bond on a form provided by the City, or a cashiers or a certified check, drawn on an Iowa bank or a bank chartered under the laws of the United States, payable to the “City Clerk of the City of Clinton, Iowa”, in the amount of five (5) percent of the bid as security that the bidder whose proposal is accepted will enter into a contract for the above, and will provide the required bonds, with sureties to be approved by the City Council, which respective sum will be retained by the said City as agreed liquidated damages in case the successful bidder fails to enter into a contract within ten (10) days after award of the contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and maintenance. The City of Clinton reserves the right to defer acceptance of any bid for a period of thirty (30) calendar days after receipt of bids and no bid may be withdrawn during this period. Prebid Conference A Prebid Conference will be held at City Hall on June 8th, 2018 at 10:00 A.M. Bid Security Bid security shall be furnished in accordance with the Instructions to Bidders. Contract Security The successful BIDDER will be required to furnish Performance and Payment Bonds as described in the General Conditions. Sales Tax Exemption The City of Clinton will issue a sales tax exemption certificate to the Contractor for all material purchased for incorporation into the project. Tax exemption certificates are applicable only for the specific project for which the tax exemption certificate is issued. NEW FLOOD MAPS FOR CLINTON COUNTY On June 12th the Iowa Dept. of Natural Resources and the Federal Emergency Management Agency (FEMA) will host an Open House to present preliminary floodplain maps to Clinton County citizens. The meeting will be held at the Clinton County Administration Building – Room B, 1900 N 3rd Street, Clinton, on Tuesday, June 12th, from 6pm – 8pm. This meeting is open to the public. The open house will provide property owners an opportunity to view the preliminary maps and learn how their flood risk may have changed. Representatives from FEMA and the Iowa DNR will be on hand to answer questions and address residents’ concerns about the preliminary flood maps. Flooding is the number one natural disaster in the United States. It is vital that property owners understand their risk and take advantage of tools or programs available to them, including flood insurance. These preliminary maps are an update of the existing maps, which date back to 2008. The maps will become the basis for local community’s floodplain management measures. Insurance companies will use the maps to determine flood insurance rates for buildings and contents. As a result of these map changes, some buildings in Clinton County may, for the first time, be included in a high-risk flood zone, known as the Special Flood Hazard Area. This may result in those affected homeowners being required to purchase flood insurance. Metzger asked if this would affect employee contracts. Kida said no, it is something additional we can offer. Kida led a discussion of an Ordinance amending the Camanche, Iowa municipal code by amending Chapter 2-12-6 and repealing Chapter 2-12-9. Willis stated that he and Brightman met with some of the Park and Recreation Commission members to obtain their input. Kida stated the Ordinance was drafted in 1974 with additions in the late 1980s and still referenced Garner Hall. Mayor Willis read the Ordinance and further discussion took place. Moved by Varner, second by Weller to approve the first reading of an Ordinance amending the Camanche, Iowa Municipal Code by amending Chapter 2-12-6, and repealing Chapter 2-12-9. Ayes – Varner and Weller. Nays – Metzger, Brightman and Campie. Moved by Brightman, second by Weller to approve a Resolution amending the current budget for FYE2018. On roll call – all ayes. Jarrod Miller from Miller Trucking & Excavating addressed the Council and requested forgiveness of liquidated damages related to the 21st Street Culvert project. The contract required the work to be completed by August 15, 2017 but was not done until September 21, 2017 resulting in $17,000 in liquidated damages. Moved by Metzger, second by Weller to pay only the $8,961.25 in retainage for the 21st Street Culvert project and not forgive the liquidated damages. On roll call – all ayes. Chief Schutte read the Camanche Fire Department report for April. Chief Reid was called out so Andrew Kida read the Camanche Police Department for April. Kida reported that the Hometown Pride Committee meeting on Monday was attended by Senator Rita Hart. The Committee has been discussing a community survey to gather information from citizens regarding our community and rebranding. He stated the Army Corps of Engineers will begin using the Swan Slough boat ramp for a staging area beginning in September of 2018 through the fall of 2021. The agreement for this easement was signed around 2006. Kida also reported the rest of the asbestos at Garner Hall is scheduled to be removed on Friday and demolition can be scheduled after that. He informed the Council that he applied for and received a $710 stipend from IACMA for attendance at ICMA in the fall. He also pointed out the Building Permits that Chief Schutte reports each month add to our tax base and increase tax revenue for the City. Metzger discussed the importance of professional conduct by Council Members, employees and board members and the need for Council Members to stay in their lane. Varner reported the Library Board is hiring a Children’s Librarian to replace Anna Evans who is now the Library Director. The Historical Society is painting the Depot and the Caboose on June 9th and is seeking volunteers to help. The Landfill board is on the cusp of replacing the current 28E agreement. Brightman reminded everyone that it is National Police Week and encouraged everyone to thank our Officers. He also congratulated the 2018 graduates. Schutte said the Autism walk will be Saturday and encouraged everyone to be cautious around the race route. Judy Dell said she has raffle tickets for sale for the Autism event. She also discussed the details of a $5,000 grant received in 2013 for the skate park that was not completed. She is concerned about the use of the money. Mayor Willis stated that we need to look into this. A recess was taken at 6:54 p.m. At 7:14 p.m. the meeting reconvened for a Work Session to discuss Fireworks. After a thorough discussion of the issue of the use of Fireworks in town, it was decided to allow use between 6:00 p.m. and 11:00 p.m. on July 4th. Kida will draft an Ordinance and submit it to the City Attorneys for review. The first reading of the Ordinance will take place at the June 5th City Council Meeting. At 8:11 p.m. the Mayor adjourned the meeting. CAMANCHE COMMUNITY SCHOOL DISTRICT BOARD OF EDUCATION MAY 21, 2018 The regular meeting of the Board of Education of the Camanche Community School District was held on May 21, 2018 at 7:30 p.m. in the Board Room of the Administration Building. The Human Resource and Planning Committees have completed the work for the school year. The Policy Committee will have also completed the work for the school year with the approval of the 2nd readings of the policies at this meeting. The Projects Committee set a meeting for May 29th at 4:30 to continue to discuss swimming pool options. Superintendent Parker shared with the Board an executive summary from Clinton Community College President, Dr. Karen Vickers, regarding the possible development of a Career and Technical Education Facility for students in Clinton/Jackson County. Superintendent Parker also reminded the Board of the retirement recognition for Gary Parker’s retirement. Superintendent Parker made inquiry with the Board if they would prefer a special meeting to discuss his evaluation or encompass that discussion at the end of the regular meeting in June. It was decided to conduct the evaluation discussion at the end of the regular meeting in June. With May being School Board Recognition Month, Superintendent Parker expressed his appreciation to the Board of Education for all they do for our community’s children. Business Director Aude once again extended her appreciation to the Administration Center staff for their coverage while she was out on medical leave. Many complimented the staff and their level of professionalism. Business Director Aude communicated a Thank You from the Camanche Kiwanis Club for use of the school grounds for the Easter Egg Hunt. Business Director Aude shared that the preliminary work has begun with registration and the audit. Business Director Aude also shared a final detail for the 18-19 employee packages explaining that the transition of the new insurance package entails some initial handling of benefits. Purpose. The purpose of this ordinance is to make and allow for exceptions to the general requirement that the abutting property owner shall be responsible to repair, replace or reconstruct, or cause to be repaired, replace or reconstruct, all broken or defective sidewalks, and to establish a legislative policy to expend public funds to assist in the maintenance and repair of the sidewalk network in the City. Section 2. Amendment. The Code of Ordinances of the City of Clinton, Iowa is amended by editing Section 97.029 as follows: § 97.029 CITY MAY ORDER REPAIRS. If the abutting property owner does not maintain sidewalks as required, the Council may serve notice on the owner, by certified mail, requiring the owner to repair, replace or reconstruct sidewalks within a reasonable time and if the action is not completed within the time stated in the notice, the Council may require the work to be done and assess the costs against the abutting property for collection in the same manner as a property tax. Notwithstanding the foregoing, the City Council may, from time time as fiscal resources are available, allocate funding for the repair, maintenance and reconstruction of sidewalks to cover whatever proportion of the repair costs it deems affordable and appropriate in a given a fiscal year, and said funds shall be allocated by priority set forth by the City Engineer. Regardless of the availability or unavailability of said funds, nothing in this section shall shift the legal responsibility of abutting owners for the present or future maintenance and care of sidewalks or for legal liability arising out of the same, as set forth in Section 97.028. (Iowa Code §§ 364.12(2)(d), 364.12(2)(e)) (1999 Code, § 136.05) Penalty, see § 10.99 § 97.030 SIDEWALK CONSTRUCTION ORDERED. In compliance with the Safe Drinking Water Act Amendments, the Town of Pax Water Company is providing its customers with this annual water quality report. This report explains where your water comes from, what it contains, and how it compares to standards set by regulatory agencies. The information in this report shows the results of our monitoring for the period of January 1st to December 31st, 2017 or earlier if not on a yearly schedule. Where does my water come from? Your drinking water is purchased from the Beckley Water Company which uses surface water from the Glade Creek reservoir and ground water from the Sweeneysburg well. Source Water Assessment The well that supplies drinking water to Beckley Water Company has a higher susceptibility to contamination, due to the sensitive nature of the aquifer in which the drinking water well is located and the existing potential contaminant sources identified within the area. This does not mean that the well field will become contaminated; only that conditions are such that the ground water could be impacted by a potential contaminant source. Future contamination may be avoided by implementing protective measures. The source water assessment report which contains more information is available for review or a copy will be provided to you at our office during business hours or from the WVBPH 304-558-2981 All drinking water contains various amounts and kinds of contaminants. Federal and state regulations establish limits, controls, and treatment practices to minimize these contaminants and to reduce any subsequent health effects. Why must water be treated? All drinking water contains various amounts and kinds of contaminants. Federal and state regulations establish limits, controls, and treatment practices to minimize these contaminants and to reduce any subsequent health effects. Contaminants in Water In order to ensure that tap water is safe to drink, EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. FDA regulations establish limits of contaminants in bottled water which must provide the same protection for public health. Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of these contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency’s Safe Drinking Water Hotline ( 800-426-4791 ). The source of drinking water (both tap and bottled water) includes rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of land or through the ground, it dissolves naturally-occurring minerals, and, in some cases radioactive material, and can pick up substances resulting from the presence of animals or from human activity. Contaminants that may be present in source water include: Microbial contaminants, such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations and wildlife. Inorganic contaminants, such as salts and metals, which can be naturally-occurring, or result from urban storm water runoff, industrial or domestic wastewater discharges, oil and gas production, mining, farming. Pesticides and herbicides, which may come from a variety of sources such as agriculture, urban storm water runoff, and residential uses. Organic chemical contaminants, including synthetic and volatile organic chemicals, which are by-products of industrial processes and petroleum production, and can also come from gas stations, urban storm water runoff, and septic systems. Radioactive contaminants, which can be naturally-occurring or the result of oil and gas production and mining activities. Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Drinking Water Hotline (800-426-4791). Water Quality Data Table Definitions of terms and abbreviations used in the table or report: • MCLG (Maximum Contaminant Level Goal):The level of a contaminant in drinking water below which there is no known or expected risk to health. MCLGs allow for a margin of safety. • MCL (Maximum Contaminant Level): The highest level of a contaminant that is allowed in drinking water. MCLs are set as close to the MCLGs as feasible using the best available treatment technique. • MRDLG ( Maximum Residual Disinfectant Level Goal): The level of drinking water disinfectant below which there is no known or expected risk to health. MRDLGs do not reflect benefits of use of disinfectants to control microbial contaminants. • MRDL (Maximum Residual Disinfectant Level): The highest level of disinfectant allowed in drinking water. There is convincing evidence that addition of disinfectant is necessary to control microbial contaminants/ • AL (Action Level): The concentration of a contaminant which, when exceeded, triggers treatment or other requirements which a water system must follow. • TT-Treatment Technique,or a required process intended to reduce the level of a contaminant in drinking water Abbreviations that may be found in the table: • pC1/1- picocuries per liter • ppm (parts per million):One part substance per million parts water (or milligrams per liter) • ppb (parts per billion):One part substance per billion parts water (or micrograms per liter) • N/A - not applicable • NE - not established • ND - ( not detected): Indicates that the substance was not found by laboratory analysis • NTU (Nephelometric Turbidity Unit):Measurement of the clarity, or turbidity, of water. Turbidity in excess of 5 NTU is just noticeable to the average person. The Beckley Water Company and Town of Pax Water Company routinely monitors for contaminants in your drinking water according to federal and state laws. The tables below show the results of our monitoring for contaminants. Table of Test Results - Regulated contaminants - Beckley Water Company-Glade Creek *Copper and Lead samples were collected from 5 area residences on 9-29-11. Only the 90th percentile is reported. None of the samples exceeded the MCL. WE ARE PLEASED TO REPORT THAT THE TOWN OF PAX WATER COMPANY MET ALL STATE AND FEDERAL DRINKING WATER STANDARDS FOR THE REPORTING YEAR 2017. Additional Information All other water test results for the year 2017 were all non-detects. Turbidity is a measure of the cloudiness in water. We monitor it because it is a good indicator of the effectiveness of our filters. If present, elevated levels of lead can cause health problems, especially for pregnant women and young children. Lead in drinking water is primarily from materials and components associated with service lines and home plumbing. The Town of Pax Water Company is responsible for providing high quality drinking water, but cannot control the variety of materials used in plumbing components. When your water has been sitting for several hours, you can minimize the potential for lead exposure by flushing your tap for 30 seconds to 2 minutes before using water for drinking or cooking. If you are concerned about lead in your drinking water, you may wish to have your water tested. Information on lead in drinking water, testing methods, and steps you can take to minimize exposure is available from the Safe Drinking Water Hotline or at http://www.epa.gov/safewater/lead. Phillip Ray DeHart Phillip Ray DeHart, age 61, passed away Thursday, May 24, 2018 at his home in Temecula, CA., presumably of a heart attack. Born July 21, 1956 on a small farm in Rowan County Kentucky, he was the only son and youngest child of Eulamae DeHart and the late Francis Curtis DeHart, both of Morehead. He attended Elliottville and Morehead Grade schools and Rowan County High School. He decided to leave high school to marry and join the U.S. Air Force but later completed his education and received his high school diploma in Romulus, Michigan, where he lived and worked for several years. Phillip possessed a strong work ethic and a heart of compassion; he would lend a hand to anyone who ask or whenever he saw a need he could supply. In the summer of 1981, he moved to southern California and eventually started Precision Landscape and Maintenance, his business in Oceanside, CA, which he ran for many years until health issues forced his retirement; he loved the California weather and being outdoors. His long-time clients came to respect and love him as family. He loved to play games, especially the card game "Spoons", a family favorite of which he was the champ! Bowling and family pool were other favorite pass times. He was an excellent shot with a twenty-two rifle and won bicycles several years in a row at the San Diego County Fair in Del Mar, CA. His wonderful sense of humor and beautiful smile will be fondly remembered as will his strong faith in and love of God, family and country. Phillip was a most loving son, dad, brother, husband and friend, but he also identified with being a child of God - Not Perfect, Just Forgiven. He held a strong belief in and much knowledge of the Christian Bible and was always ready to share the love of God and the gospel of Jesus Christ with anyone who would listen or when he believed he was called to do so. When visiting family in Morehead, he often worshiped with the members of the Johnson First Church of God. A man with a tender and loving heart, especially toward his mom from whom he first learned of the love and hope of Jesus, he leaves a huge void that will never be filled but by the love and grace of God. Besides his ninety-year-old mother, he is survived by his second wife of 35 years, Tamara DeHart, and their four surviving children: two sons, Jonathan DeHart (Erika) of Carlsbad, CA and Daniel Ray DeHart (Hannah) Temecula, CA, and two daughters, Phillisha and Nicole DeHart of Temecula, CA. He was preceded in death by their two daughters Tiffany and Michelle DeHart. In addition, from his first marriage to Kathy Skaggs, (deceased) of Romulus, Michigan, he leaves behind his two daughters Brandy Towler (John) of Florida and Heather DeHart of Michigan. There are also five surviving sisters who live in Kentucky: Jeanie Williams of Winchester, Lowone Carolyn White of Salyersville, Jewell ‘Fay” Hunter and Susan York both of Morehead and Loretta Cole of Clearfield, nine grandchildren and one great-grandson. Also, remaining are nieces and nephews Angela Faith White, Claudia Strange, Karen Adams, Nathan Hunter, Aaron DeHart and David York, as well as a maternal great uncle Walter Gee (Martha) of Arizona and many, many cousins and friends. Furthermore, he was paternal nephew of the late William Dehart of Morehead, Otis and Reba Caudill of Olive Hill, Richard and Katie Goodman of Morehead, Estill Hamilton, and maternal nephew of Lucy Bowling of London, Louise Easterling of Clearfield, and Oscar, Edward and Virgil Gee. Although the desire is to celebrate his life and focus on wonderful memories of him, hearts are heavy as he will be sorely missed by his family and all who knew him. A funeral service will be held at England Family Mortuary in Temecula, California Thursday, June 7, 2018 from 4:00-7:00, after which the family there will lovingly gift his remains for transport to his family here in Kentucky. A Celebration of Life service will be held in Morehead, Kentucky at the Dehart Family Cemetery, Trent Ridge Rd on Saturday, June 16, 2018 at 1:00 PM. Michael R. Gray Funeral Home is graciously handling the arrangements for the graveside service. Those who want to partake in the funeral procession will meet briefly at Michael R. Gray Funeral Home, 808 Old Flemingsburg Rd, Morehead, KY at 12:00 noon. Anyone wishing to attend to share in the celebration of Phillip’s life is welcome and attire need not be formal. If you wish more information, please call Michael R. Gray Funeral Home of Morehead. Pallbearers are Daniel Russell, Robert Russell, and tentatively at present, David York, Logan York, Jonathan Dehart and Jeff York. Honorary pallbearer, Karen Adams. There are no expectations of flowers or gifts but if you have the need to express your love and respect for him or condolences for the family, please, in lieu of flowers, make donations to the Phillip DeHart Memorial Fund/Susan York, c/o The Citizens Bank 216 Kroger Shopping Center, Morehead, KY 40351, or an agency to fund research for the cure of diabetes and/or heart disease.
